What Top1031 is and is not

Top1031 is a data and educational publisher covering 1031 exchanges and Delaware Statutory Trust offerings.

We are not a broker-dealer, investment adviser, tax advisor, or law firm, and nothing on this site is investment, tax, or legal advice.

Nothing here is an offer to sell or a solicitation of an offer to buy a security. Offers are made only through current offering documents.

Public educational content and tools are available without an account. Gated directory data is intended for users who self-attest that they meet the accredited-investor definition.

Data, Sponsor Grades, and no warranties

• Directory information is derived from public SEC filings, sponsor disclosures, and other cited public sources. We work to keep it current, but it is provided "as is," without warranty of completeness, accuracy, or fitness for any purpose.
• Sponsor-reported figures are labeled as such. Top1031 may confirm that a cited source contains a figure, but it does not audit the sponsor's calculation.
• Top1031 Sponsor Grades are editorial opinions produced under a published methodology from cited public evidence. They are not investment recommendations or predictions and should not be the basis of an investment decision.
• If you believe a cited Sponsor Grade input is wrong, you may submit supporting public evidence for review.
• Calculators and tools produce general, illustrative estimates from the inputs you supply. Your actual tax outcome depends on your circumstances.

Accounts

Account access uses single-use email codes. A new member may complete the accredited-investor self-attestation and pending profile while the code is in flight; access and verified consent provenance are granted only after the code verifies control of the address. A pending address that is never verified expires under the retention schedule in our Privacy Policy.

The optional Contact Opt-In is selected by default and can be unchecked before submission without affecting account access. Name and US phone number are required while it remains selected and optional after it is unchecked. Both are required if you send an advisor note.

Some signups originating from paid advertising use a partner-supported registration flow instead of the optional Contact Opt-In checkbox. In that flow, full name and US phone are required. By submitting the profile and verifying the email code, you authorize a Top1031 partner specialist to call or email you about your exchange, and a Lead is delivered for that purpose. This does not authorize text messages. Do not complete that registration flow if you do not agree to partner contact.

Top1031 does not store the raw ad-click identifier in account or Lead records. Advertising providers may separately process identifiers to attribute the signup and advisor-contact conversions described in our Privacy Policy.

Leaving Contact Opt-In selected authorizes specialist outreach after verified standard signup. Uncheck it before submission for account access without specialist outreach. Contact Opt-In or an advisor note authorizes a response by email or phone, not by text message.

Top1031 may send sign-in codes and account, security, service, or retention notices. Anyone with access to your email inbox may be able to access your Top1031 account. You are responsible for keeping that email account secure and for promptly signing out all sessions if you believe access was compromised.

You can sign out one or all devices and request permanent account deletion from the account page. Deletion requires a fresh single-use email link and is subject to the narrow pseudonymous legal and security records described in our Privacy Policy.

We may suspend or close accounts that abuse the service.

Acceptable use

You may link to, quote, and cite this site with attribution.

You may not:

• Scrape or bulk-harvest the directory for redistribution or resale.
• Misrepresent Top1031 data or Grades as your own or as ours where altered.
• Use the site to harass sponsors or other users.
• Probe, disrupt, or overload the service.
• Use registered data surfaces for purposes other than your own exchange evaluation.

Search-engine and AI-assistant crawling consistent with our robots.txt is welcome.

Intellectual property

The site's editorial content, grade methodology, compilations, and design are owned by Mangold, Inc. or its licensors. Underlying government filing facts are public; our selection, enrichment, and presentation of them are not.

Limitation of liability

To the fullest extent permitted by law, the site is provided without liability for investment outcomes, data errors, or interruptions.

Mangold, Inc.'s total liability for any claim relating to the site will not exceed one hundred dollars (US $100).

Some jurisdictions do not allow certain limitations. Those limits apply to the maximum extent permitted. Nothing here limits liability that cannot lawfully be limited.

Disputes, governing law

These terms are governed by the laws of the State of Delaware, without regard to conflicts rules.

Disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

If any provision is unenforceable, the remainder stands.

Changes

We may update these terms. Revised terms will be posted here with an updated "Last updated" date.
