Published Updated

NB Mountain Valley, DST filed a voluntary Chapter 11 petition on August 19, 2025 in the U.S. Bankruptcy Court for the Northern District of West Virginia, per PACER and investor-loss notices carried in Top1031's disposition record. The 658-bed Mountain Valley Apartments is the only asset of the single-asset Delaware Statutory Trust (DST), which opened its offering with a Form D on August 10, 2017. NB Mountain Valley Leaseco, LLC, the affiliate that leased the property, petitioned the same day in the same court, under the same case.

The petition reported assets and liabilities each between $10 million and $50 million, per the same record.

Two labels sit side by side in the record, and they do not agree. Top1031's data records the exit as a foreclosure dated August 1, 2025. The case material underlying that entry describes the voluntary Chapter 11 petition of August 19, 2025 and states no foreclosure sale. This report treats the Chapter 11 filing as the disposition, because that is the event the case record documents.

Neither the trust's public filings nor the case record states a disposition value, a total return, or any figure bearing on the eventual result for investors. The Form D names no sponsor.
